10 Important Case Laws 1. Indira Sawhney v. Union of India : Known as Mandal Judgement. Reservation for backward classes based on the principle of equality among equals in Article 14. However the creamy layer were to be excluded. 2.T.M.A. Pai Foundation Case : The rights of minorities to establish and administer educational institutions was upheld. 3. Ashok Kumar Thakur v. Union of India : Providing 27% reservation for OBCs. 4. Indira Gandhi v. Raj Naraian : The 39th Amendment of the Constitution which laid down that the election to Parliament of any person who is holding the Prime Minister's office could not be challenged was declared as unconstitutional and struck down. 5. Sunil Batra v. Delhi Administration : A PIL could be instituted even by a third party who is moved by an inhuman treatment. 6. Vishaka v. State of Rajasthan : The Supreme Court laid down rules to protect women against sexual harassment in workplaces. 7. Maneka Gandhi v. Union of India : The right to go abroad was held as part of one's fundamental right to life and personal liberty under Article 21. It was also held that the law falling under Art. 21 must satisfy the test of Article 19. 8. Mohini Jain v. Union of India : Right to education was considered to be a part of Art. 21. 9. Govind v. State of M.P. : Right to privacy was read into Article 21. 10. Unnikrishnan v. State of Andhra Pradesh : Right to free and compulsory education up to the age of 14 was read into Article 21.
